While new countries have been designated for TPS, not all nationals are able to qualify even if they have been in the United States for the requisite period. This webinar will explore the different barriers to TPS eligibility, including the applicable grounds of inadmissibility as well as the criminal and asylum bars. Firm resettlement will be explained in detail and guidance for arguing this bar does not apply or an exception applies will be outlined.

Presenters

Allison Davenport joined the ILRC in 2015 as a staff attorney based in California's Central Valley, where she was born and raised. Prior to joining the ILRC, she was a clinical instructor with the International Human Rights Law Clinic at UC Berkeley School of Law. At the clinic she directed the establishment of the Legal Support Program for undocumented students, the documentation of human rights abuses against LGBTI individuals in El Salvador, and the promotion of equal access to clean water in California.  Allison practiced immigration law, first in private practice and then as founder of the immigration legal services program at Centro Legal de la Raza. Allison also formerly worked as a staff attorney with the Center for Gender and Refugee Studies at UC Hastings. She graduated from UC Berkeley with a JD and an MA in Latin American Studies. Allison speaks Spanish.

Peggy Gleason, who has dedicated her career to immigrant rights, joined ILRC in 2019 as a senior staff attorney in Washington, D.C.

She worked most recently in the Office of Civil Rights and Civil Liberties at the Department of Homeland Security, dealing with civil rights complaints concerning U.S. Customs and Border Protection. Earlier, she worked on family and humanitarian immigration policy and legal issues for the Citizenship and Immigration Services Ombudsman and on legal access issues for the Department of Justice Executive Office of Immigration Review.

Before her time with the federal government, she was a senior attorney for Catholic Legal Immigration Network's training and technical support section for 23 years, providing technical assistance and training to CLINIC's affiliated programs and other nonprofits nationwide. She also represented immigrant clients of Catholic Charities Immigration Legal Services for the Archdiocese of Washington. She began fulltime practice of immigration law while working for the Colorado Rural Legal Services Farmworker Program.

She graduated from the University of Wisconsin-Madison with a B.A. in Ibero-American Studies and earned her J.D. at Antioch School of Law in Washington, D.C. She is a member of the Colorado Bar.

Peggy is a frequent speaker on immigration law topics and contributor to publications. She speaks Spanish.

Aruna Sury is an immigration attorney with vast experience in removal defense, immigration consequences of crimes, and federal appeals. She is based in Seattle, WA and provides consultation and litigation support to attorneys throughout the country. Through ILRC's Attorney of the Day program, Aruna provides legal guidance to criminal defense and immigration counsel. She regularly contributes to ILRC publications by authoring and updating content that enables practitioners to provide high quality representation to their clients. Aruna also presents ILRC trainings and CLE courses on a variety of topics.

Since obtaining her law degree from the University of Texas at Austin in 2001, Aruna has dedicated her career to the areas of immigration and civil rights in various settings in San Francisco, Seattle, and Austin. She has worked in law firm and solo practice environments as well as in non-profit and public organizations, including Washington Defender Association, University of Washington, Kids in Need of Defense, and Political Asylum Project of Austin (now American Gateways). Aruna's personal interest is in immigrants' due process rights, particularly the right to effective counsel and expansive access to judicial review. She has secured published and unpublished Ninth Circuit decisions in these and other areas. She has also successfully litigated cases in the First, Fourth, Fifth, and Eleventh Circuits.
