Section 212(h) is an extremely useful waiver of inadmissibility used to prevent disaster, especially when the client cannot apply for LPR or non-LPR cancellation. This interactive webinar will cover who can apply, when it can be filed, standards for granting it, and when additional restrictions do or do not apply to permanent residents. This training is intermediate-level and assumes some familiarity with inadmissibility for crimes and waivers in general.

Kathy Brady, Senior Staff Attorney - Immigrant Legal Resource Center
Kathy Brady is a Staff Attorney based in San Francisco. She has worked with the ILRC since 1987. Along with expertise in family immigration, immigrant children and youth, and removal defense, she is a national expert on the intersection of immigration and criminal law. She is a frequent speaker and consultant, and has co-authored several manuals including Defending Immigrants in the Ninth Circuit (ILRC), California Criminal Defense of Immigrants (CEB), the chapter on representing immigrants in California Criminal Law – Procedure and Practice (CEB), and Immigration Benchbook for Juvenile and Family Courts (ILRC). She helped found coalitions and projects to address these issues, including as a co-founder of the Defending Immigrants Partnership and the Immigrant Justice Network. Kathy served as a Commissioner to the American Bar Association Commission on Immigration from 2009-2012. In 2007 she received the Carol King award of advocacy from the National Immigration Project of the National Lawyers Guild.
Before working at the ILRC Kathy was in private practice in immigration law with Park & Associates in San Francisco.
Kathy attended Stanford University and the University of California Berkeley School of Law, and has taught immigration law as an adjunct professor. She is a member of the California Bar and is conversant in Spanish.
Rebecca Sharpless, Director, Immigration Clinic - University of Miami Law School
Professor Rebecca Sharpless directs the Immigration Clinic at the University of Miami Law School Immigration Clinic. Before that she was a Supervising Attorney at Florida Immigrant Advocacy Center (FIAC), where she engaged in extensive litigation on behalf of low-income immigrants as lead or amicus counsel in cases before the Supreme Court, the United States Courts of Appeals, United States District Courts as well as immigration court. She has received awards and recognition for her work, which includes a focus on immigration consequences of crime, unaccompanied immigrant children, and asylum.
Ben Winograd, Attorney - Immigrant and Refugee Appellate Center (IRAC)
Ben Winograd is an attorney at the Immigrant and Refugee Appellate Center (IRAC) in Virginia, and the author of the Index of Unpublished Decisions of the Board of Immigration Appeals. He previously worked as a staff attorney at the American Immigration Counsel. He has litigated key cases before the BIA and federal courts of appeals nationally, and is the recipient of the 2017 Joseph Minsky Award from the American Immigration Lawyers Association for outstanding contributions made as a young lawyer.
